JOWMA and the Tochecha: This world is not a Hefker Velt! יש דין ויש דיין

שֹׁפֵךְ דַּם הָאָדָם בָּאָדָם דָּמוֹ יִשָּׁפֵךְ כִּי בְּצֶלֶם ה׳ עָשָׂה אֶת־הָאָדָם
HaKadosh Baruch Hu tells us in Bereishis 9:6 that an unborn child is a human life, and ending its life is murder.
Yet, the Jewish Orthodox Women’s Medical Association clearly differs with the Creator of the world, as they encourage mothers to terminate their babies’ lives in utero.
Last Sunday, May 7, in the week of Parshas Behar-Bechukosai, in the Parsha of the tochecha itself, JOWMA held an event that certainly set a rock-bottom record for an organization (pretending to be) geared to the frum community and faithful to Halacha.
The abortion provider doctor who spoke for about a half hour described in detail the various ways an abortion can be performed at different stages of pregnancy - i.e. she talked about how she murders babies for a living.
She consistently stressed how safe abortion is. In fact, she said that pregnancy is more dangerous than skydiving (I wonder why we never knew that?) and that ending a pregnancy is ALWAYS safer than continuing it.
This was not about saving the mother’s life. This was about terminating unwanted pregnancies.
An unbelievable, extremely serious breach has opened in Klal Yisrael, which can only lead to devastating consequences, chas veshalom. In fact, the Zohar teaches us that abortion is one of three extremely serious sins which cause the Shechina to depart from amongst us, resulting in tragedies, Rachmana Litzlan.
Here is the Halacha, quoted from a distinguished senior Talmid Chochom and Posek:
The Halacha is straightforward. Abortion is MURDER.
The status of an unborn child however is not the same as a born person. The only difference being in a case where the child is causing the mother to die unless he is aborted. Then the sub level of life that the child has gives precedence to the life of the mother and we may abort to save her life. Just as we can kill a Rodef. If however the head is out he is considered a full life just like the mother, and then even if his birth is killing the mother, since he is not intentionally being Rodef her, we do not intervene even if the mother will die.
I requested: Please elaborate on the status of a person who performs abortions which are not required to save the mother’s physical life.
Is a murderer. According to the Torah has transgressed the most severe sin. Even with Teshuva (very difficult) remains stained. Will suffer greatly in this world, besides punishment in the next.
In answer to my query about “psychological reasons” that people are claiming allow for this murder:
Psychological reasons??? for the murderer to permit murder do not exist. If the mother threatens suicide it’s a sofek death and killing the baby is Vadai, אין ספק מוציא מידי ודאי.
They CERTAINLY have מתירים. But they’re עמי הארץ.
In response to people who are killing their unborn children because the doctors claim that the child has defects:
First of all, many, many times the in utero diagnoses are completely wrong. I have had quite a number of Shailos about a baby that can NOT בשום אופן survive, i.e. his head is the size of a finger, or he’s for sure Down’s Syndrome, and when the baby’s born, Lo and Behold!! He’s 100% normal. Head the same size as yours and mine!! Not Down’s.
So! To even take the diagnosis seriously is a joke. Shlomo HaMelech wrote

He used the impossibility of knowing כעצמים בבטן המלאה as an example of things we cannot know - and this still holds true in the age of sonograms.
You don’t know !!!
Next; even if the baby is lacking all his parts, he is still a baby. Even if his life is completely “unproductive,” it’s still the exact same murder.
Whether or not his life is worth living according to the Eugenicists ימח שמם וזכרם, he’s a נפש!!! And according to the Torah it’s absolutely Murder - Capital Murder - to extinguish his life.
The Rav raised a very important point. The philosophy of eugenics is the one which tells us that some people are untermenschen, their lives better off not being brought into this world, and that they aren’t worth the trouble those around them must go through to care for them and support them. This was the Nazis’ philosophy.
It was apparent from the abortion provider’s talk that many of her patients are Orthodox people coming in for fetal malformations.
Other people are simply terminating pregnancies because they don’t want to have a baby.
I never could have imagined that we would sink this low.

Dr. Elizabeth Schmidt, the abortionist, begins her talk:
“… I really wanted to talk about the safety of abortion, um, versus childbirth
… so this is just a graph - we're really doing a very bad job at protecting, um, pregnancy capable individuals … we're doing a really terrible job protecting birthing people
… I think something that we don't really conceptualize is that pregnancy carries significant risk
.. so just so that we're all on the same page if you've heard the term D and C dilation and curettage this is the procedure to remove pregnancy tissue from the uterus this is a very common procedure it's the same procedure we use to terminate a live pregnancy or to remove um if you've had a miscarriage
… abortion is incredibly safe - the risk of dying from a first trimester termination is about one out of a million
… but the risk of dying from a full-term pregnancy is actually much higher. Now that roe has been reversed, it has been posited that the risk of dying from pregnancy is actually going to increase
… so let's switch gears I wanted to talk about the methods of terminating a pregnancy … so in the first trimester that's the first three months of pregnancy up to 14 weeks we can take pills which is called medical management and we typically use that up to um 11 12 weeks, or we can do a procedure which is called the dilation and curettage. In the second trimester, which is above 14 weeks, we can still do a procedure which is called a dilation and evacuation. We’ll typically do the procedures up to about 26 weeks. Also, above 14 weeks we can do what's called an induction where you go to labor and delivery and we give you medicines and you would deliver.
… this is how I counsel my patients .. I'll go through both options do you want medical management, do you want surgical management? .. I can do the vacuum the DNC in my office .. and it is very quick we can give oral pain medication … this is a suction machine on the left when we're in the operating room and then we also use little handheld vacuums when we're in the office, it doesn't make any noise. In the office it takes about five minutes, it's very easy and very safe to do .. we also can give you anti-anxiety medicine in the office for pregnancies further along
.. regarding the safety of abortion this is the same for if you have a pregnancy loss or if you are terminating a pregnancy for either fetal anomalies or for unplanned pregnancy there are no risks for infertility in the future
… so all in all pregnancy actually is dangerous um and those risks can be higher for certain groups. Induced abortion is extremely common - about one out of four women will need an abortion in the in the United States. Most people can be offered either procedural or a medical abortion and both options are very safe
… overall, complications are very low for both procedures. Abortion is very safe and it is always safer than continuing a pregnancy.”

A sarcastic thought: Why don’t they offer pain or anti-anxiety medication for the baby, at least, before they kill him or her? The baby is also a living and breathing person who wants life and feels pain when he or she is ripped apart alive and anxiety as he or she senses danger.

“But if you will not listen to Me and will not perform all of these commandments;

In the Navi Yechezkel Perek 33 are some critical messages for us.

בְּאָמְרִי לָרָשָׁע רָשָׁע מוֹת תָּמוּת וְלֹא דִבַּרְתָּ לְהַזְהִיר רָשָׁע מִדַּרְכּוֹ הוּא רָשָׁע בַּעֲוֺנוֹ יָמוּת וְדָמוֹ מִיָּדְךָ אֲבַקֵּשׁ
(Hashem says to Yechezkel) “If I say of a wicked person, ‘Wicked one, you shall surely die!’ and you do not speak up to warn the wicked one concerning his way - he is wicked and will die for his iniquity, but I will demand his blood from your hand.” (33:8)
וְאַתָּה כִּי־הִזְהַרְתָּ רָשָׁע מִדַּרְכּוֹ לָשׁוּב מִמֶּנָּה וְלֹא־שָׁב מִדַּרְכּוֹ הוּא בַּעֲוֺנוֹ יָמוּת וְאַתָּה נַפְשְׁךָ הִצַּלְתָּ
But you, if you did warn the wicked one concerning his way to repent from it, but he did not repent from his way, he will die for his iniquity, and you will have saved your soul.” (33:9)
וְאַתָּה בֶן־אָדָם אֱמֹר אֶל־בְּנֵי־עַמְּךָ צִדְקַת הַצַּדִּיק לֹא תַצִּילֶנּוּ בְּיוֹם פִּשְׁעוֹ וְרִשְׁעַת הָרָשָׁע לֹא־יִכָּשֶׁל בָּהּ בְּיוֹם שׁוּבוֹ מֵרִשְׁעוֹ וְצַדִּיק לֹא יוּכַל לִחְיוֹת בָּהּ בְּיוֹם חֲטֹאתוֹ
“Now you, Son of Man, say to the children of your people: The righteousness of the righteous person shall not rescue him on the day of his rebellious sin; and as for the wickedness of the wicked person - he shall not stumble over it on the of his repentance from his wickedness; but the righteous person cannot live because of [his righteousness] on the day he sins.” (33:12)
בְּאָמְרִי לַצַּדִּיק חָיֹה יִחְיֶה וְהוּא־בָטַח עַל־צִדְקָתוֹ וְעָשָׂה עָוֶל כָּל־צִדְקֹתָו צִדְקֹתָיו לֹא תִזָּכַרְנָה וּבְעַוְלוֹ אֲשֶׁר־עָשָׂה בּוֹ יָמוּת
“If I say of a righteous person that he will surely live, and he relies on his righteousness yet practices corruption, all his righteousness will not be recalled, rather because of his corruption that he practiced, for that he will die.” (33:13)
The underlying messages are very frightening. Hashem’s judgement is exacting. Nothing is overlooked or forgotten. People who are NOT personally mixed up in the evil are warned that they CANNOT be passive bystanders, or they will suffer the same fate as the wicked ones, for having remained silent.
Therefore I cry out loud:
Please join me in awakening our people.
Rav Shmuel Berenbaum zatzal wrote (on Parshas Behar) that when we keep Shemitta, we show our recognition that Hashem created the world and is the Baal Habayis of it.
On the flip side, when Klal Yisrael neglected Shemitta, we demonstrated a belief that we are the “owners” of Eretz Yisrael, rather than HaKadosh Baruch Hu, chas veshalom - and that is why exile from our land is the logical consequence for lack of proper Shemitta observance.
I believe that Rav Berenbaum’s words are an important warning to anyone who has adopted the foreign concept that people are the “owners” of their bodies and have the “right” to kill a child inside their body. Such a “choice” does not exist. The Creator of the world is the owner of our bodies, not us, and tells us clearly in His Torah what we may and may not do.
Defying His words only brings tragedy and destruction, whether in the short run or the long run. No one gets away free. Yesh Din V’yesh Dayan. Nobody will better their life outcome by ignoring the Torah.
